Introduction
GAIA processes your personal data carefully, securely, and confidentially. We want you to have confidence in our organization, and that is why we ensure the best possible respect for your privacy. Anyone authorized by GAIA to access personal data is required to respect its confidentiality. The rules relating to privacy protection are set out in the General Data Protection Regulation (GDPR), which stipulates that the Data Protection Authority monitors compliance with the law. GAIA operates within the framework of this legislation.
What personal data do we process?
GAIA processes personal data for the purpose of receiving donations, accepting and settling other benefits, conducting promotional activities, and complying with legal obligations.
GAIA processes the personal data that you consent to provide us with in the context of the following activities/categories (in principle: name, address, place of residence, telephone number and email address):
- Membership applications
- Volunteer applications
- Donations
- Newsletter subscriptions
- Use of the contact form
Why does GAIA process your data?
We share this data with affiliated entities (in relation to the categories/activities described in point 3.2) and use your data to inform you about GAIA’s activities. As soon as you are no longer involved in one of the categories/activities described in point 3.2, this data is deleted.
Below, we describe the different ways in which we process this data, as well as your rights in this regard.
Newsletter
When you subscribe to our newsletter, you consent to your usage (email opening, clicks within the email) being tracked by GAIA via the analytics tool provided by Campaign Monitor. This tool also collects information on email forwarding, undelivered emails, and unsubscribes. The personal data collected by Campaign Monitor includes your name, email address, and geographical location. To send its newsletter, GAIA uses the principle of consent. By providing your email address, you give us explicit permission to send you this newsletter. You can unsubscribe from the newsletter at any time using the link provided in each email.
Your data will not be shared with third parties (except with credit institutions or banks for the purpose of processing payments for which the data was provided).

Does GAIA share data with third parties?
In order to achieve its objectives, GAIA sometimes works in collaboration with third parties. This work is carried out on behalf of GAIA and in accordance with the law.
GAIA shares your data with:
- A telemarketing agency, which may contact you by telephone if you have consented to this when you joined/donated to GAIA;
- A fundraising agency, which may contact you by email and by post if you have consented to this when you joined/donated to GAIA;
These parties are our subcontractors. GAIA ensures that the exchange of data with these parties complies with regulations.
Is your data processed outside the EU?
GAIA’s policy is to process personal data only within the EU. Since the General Data Protection Regulation applies within the EU, this is a way of ensuring an adequate level of protection for your data.
How do we secure your personal data?
The security of personal data is a crucial issue, and GAIA maintains a strict policy in this regard. We process personal data exclusively within the EU. We also implement several technical and organizational measures to ensure that this data cannot be misused or fall into the wrong hands.
How long is your personal data retained?
GAIA does not use your data for longer than necessary.
- We delete your address if you inform us that you do not wish to be contacted for commercial purposes;
- Email address: we retain your email address as long as you are subscribed to our digital newsletter and have not unsubscribed;
- Telephone number: we delete your telephone number if you inform us that you do not wish to be contacted for commercial purposes;
What are your rights regarding the processing of personal data?
At GAIA, it is important that you are able to exercise your legal rights regarding privacy. You can easily contact us via the contact form available on our website to exercise the following rights:
- The right of access: you have the right to access the personal data we process about you;
- The right to rectification: if the personal data we process about you contains errors, you have the right to have it corrected;
- The right to erasure: if your personal data is no longer necessary for the purpose for which we received it, you have the right to ask us to delete it;
- The right to restriction of processing: you have the right to request a “restriction” of the processing of your data during the period in which we are examining whether it should be corrected, whether it is subject to unlawful processing, whether it should be deleted, or whether you have objected to its processing;
- The right to data portability: if you request it, we must transfer all the personal data we hold about you to you or to another institution. You can only exercise this right if your data is processed on the basis of consent or a contract;
- The right to object: you can object to the use of your personal data. If it is processed for legitimate or public interest purposes, a balancing of interests will be carried out. In the case of direct marketing, you have an absolute right to object.

Changes
GAIA will modify this privacy statement, for example, if there is a change in the processing of personal data.

GAIA is a non-profit association (asbl).
Article 1 – Definitions (in alphabetical order)
- Beneficiary: legal entity (GAIA) receiving a contractual donation, which will be used within the framework of the application of its statutes.
- Contract: distance contract between the beneficiary and the donor.
- Distance contract: a contract which, within the framework of a donation system organized by the beneficiary, exclusively uses one or more means of distance communication for the conclusion of the contract.
- Withdrawal period: the period during which the donor may withdraw from the contract.
- Donation: cash amount paid by a donor to GAIA.
- Donor: natural or legal person making a donation to GAIA via an electronic authorization from the GAIA website.
- Online donation: donation of money to GAIA via an electronic authorization from the GAIA website.
- Donation form: means of making an online donation to GAIA.
- Statutes: GAIA aims to protect against cruelty, mistreatment, and abuse of animals and defends animal rights.
Article 2 – Scope of application
- These general terms and conditions apply to all online donations received by GAIA.
- By making an online donation, the donor accepts these general terms and conditions.
- GAIA reserves the right to modify these general terms and conditions at any time.
Article 3 – Rights of the beneficiary (GAIA)
- Online donations are paid entirely to GAIA.
- GAIA is entirely free to decide how it uses online donations, subject to compliance with its statutes.
- Ownership of the donated amount is transferred to GAIA once the donated amount is deposited into its bank account.
- Liability: GAIA disclaims all liability for any damage suffered by the donor resulting from the donation made by them. The donor releases GAIA from any claims from third parties due to any damage suffered by them as a result of the donation made by the donor.
Article 4 – Donor Rights
- The donor has a withdrawal period of eight (8) business days for any online donation made via a donation form. During this period, the donor has the right to terminate the contract in writing by sending an email to info@gaia.be.
Article 5 – GAIA’s Obligations
- GAIA undertakes to use the donated funds in accordance with its statutes.
- GAIA takes the necessary technical and organizational measures to secure communication, personal data, electronic data transfer, and online donations and ensures a secure online environment. This is an obligation of means. GAIA disclaims all liability regarding this obligation.
- All persons authorized to access personal data by GAIA are required to treat it with complete confidentiality.
Article 6 – Donor Obligations
- To enter into a contract with the beneficiary, the donor must be of legal age. By entering into a contract with the beneficiary, the donor declares that they meet this requirement.
- Donors under 18 years of age may only make an online donation and payment in the presence and with the authorization of an adult or guardian.
- The donor undertakes to provide their identity correctly.
- The donor only makes donations with money that they own and are authorized to use.
- Provided that the GAIA association is informed, it will file a report with the police if the donor makes donations under a false name or identity, or with money that they do not own and are not authorized to use.
- The donor shall ensure, where applicable, that they have obtained the necessary authorization.
Article 7 – Processing of Personal Data
- GAIA will process the personal data provided by the donor in accordance with all applicable (legal) provisions, in particular the provisions of the law relating to the protection of privacy with regard to the processing of personal data.
- GAIA will process this personal data in the context of donations, the acceptance and processing of other forms of benefits, and the organization of marketing activities, as well as to fulfill legal obligations.
- The donor may request that their data not be used for future marketing activities by sending an email to info@gaia.be.
- The donor has the right to verify the accuracy of the data recorded by GAIA, to correct it if it proves to be incorrect, and to have it deleted. In this regard, GAIA is authorized to verify the legitimacy of the information provided by the donor.
Article 8. Final Provisions
- The disclaimer and privacy statement used by GAIA apply in full.
- The court has exclusive jurisdiction over all disputes arising between GAIA and the other party. The court of Brussels has jurisdiction over such disputes. Disputes in this context also include those disputes that are perceived or considered a dispute by only one of the parties.
- The parties declare that Belgian law applies.
